Hi,
My parents' and 2 brothers' B2 visas got rejected yesterday. The VO didn't state the refusal reason. He didn't stamp anything on their passports. I got my GC through asylum, and will get married in Nov. 2009. I supplied a formal letter from my pastor about the wedding that it's real. And my parents stated that they are not bringing my youngest brother to the US because he has school. During the interview, the VO asked them about me. He knew that I got my GC through asylum. He asked if I work or go to school. My parents answered honestly that I'm currently working to support myself.
My parents didn't show their bank account, certificate of properties and business because the VO didn't ask for it. Should they show them to VO eventhough he didn't ask to see it?
Now, we're preparing to apply B2 visa for a second time. Here are my questions:
1. When do you think they should apply for the visas again?
2. What can I do to support the fact that they will definitely go back to their country? Should we write a letter stating the reasons why they won't immigrate to US?
3. My parents are taking care of my elderly grandfather, 80 years old. Should they state this for a reason they'll come back, and also bring his photo?
4. Will they get a better chance if they leave all of my 3 younger brothers at home?
Help...help....please...I really want them to attend my wedding.

I requested(May 02nd) them to approve my case using "Cross-Chargeability", since my wife was born in non-retro country. But from June 01st, my PD (India) also becomes current. I really don't know what to do now?

My husband has been wanting to file a petition under EB-1- EA category. At this point, his credentials are as follows:
1. MS from US university
2. 3 years Job experience in an American Company
3. 14 Paper publications in his masters
4. 2 Patents
And we are still unsure how many papers were cited. He has not written journal papers but may even write few journal papers.
No awards, No member of any jury.
Do you know what chance we may stand in filing under EB-1 and in meeting the 3 requirements in EB-1 Category.
At this point, he can add to his credentials only a few more journals and search for citations.
His company director may be willing to write a letter for him.
Please help us on how to proceed. I do worry a lot in this regard.

I have a very complicated case, and I need some answer that can release me from all this stress.
I came to the United States country in 2007 with a F1 visa. I won a scholarship sponsored by the government of my country to complete a bachelor degree. I was sent to a community college to improve my English skills. I finished my associated degree at the community College last spring 2009. Since my school only issued the I-20 until June 2009, my visa was also issue until that date. Therefore, my visa is already expired. However, already got accepted into a 4 year college and I am starting in Fall 2009, so I am still under F1 status.
The institution that is sponsoring my scholarship agreed to pay for my bachelor. However, they are requesting all scholarship students to change their status to j1 by the beginning of spring 2010. If I don't do it, I will lose my scholarship and therefore my status since I don't enough money to pay for the very expensive tuition. The institution wants us to go back for two years after we finish our bachelor, so they forcing us to change our visas.
I have been living with my girlfriend since last year. She is a Permanent Resident since 2003 . She is planning to apply for citizenship on February 2010. We are planning to get married by the end of this month (August). I need to go back to my country to change my status to j1 by the end of the fall semester, so I can keep my scholarship.
Here are my questions:

My spouse and I have been notified through I-797C notice of action letter of the interview for (form-1-485, application to register for permanent residency). They require us to bring along a checklist of items for the interview including form I-864 that needs to be attached with Tax returns and W2 or certified IRS printouts.
Both of us have been in US for 15 years holding F1 and later H1B visas. The problem is that one of us (who is the dependent) has worked in several organizations without authorization. We would like to know what cause of action to take to mitigate the problem as well as the worst-case scenario in terms of our ability to obtain residency. Any advice, particularly those who know of someone who has faced a similar situation will be appreciated.

Is there any way we can check our labor processing status as it is a genral fact that no employer would prefer to give his employee to access his status and at the same time they would not let employee to call attorney directly.So in this kind of scenario I was just wondering is there anyway we can track the status.

Unfortunately the answer is No.
You will have to wait (and trust) for your employer/attorney to give you this info.
Also you can check on the current perm processing dates which the USCIS issues I think every 3 months to see
how far the queue has moved and if you know approx date when your labor was filed you can make a guess
based on the published date and your filing date

I had applied for 485 in July with Future Employer in EB3.
After 6 months, I want to port the application to my existing employer. At that time, is it possible to convert the application from EB3 to EB2 using AC21 portability??
Any help is appreciated!!!
I dont think u can convert from EB3 to EB2 and AC21 are two different things.
AC21 is for chnaging employers after filing AOS and is pending for more than 180 days.

You message is not clear. Are you saying he cannot work without getting a new H1. If he needs to get a new H1, then he needs to go out of the country for more than a year and come back later with a new H1.
I beleive, he can do H1 transfer. By the way, the new company should also start your labor and I140. Still you can port your PD if you have already 140 approved.
